What is an invention?

An invention solves a specific problem with the means of technology. The technical features of the invention fulfill a function, whereby the problem - the object of the invention - is solved. The technical character required for patenting means that the laws of nature must be used to achieve the goal. An invention is also referred to as a "teaching on technical action".

The invention can relate to a product or a process:

Products include:

  • Products such as goods and tools
  • Devices such as production plants and machines
  • Materials such as chemical substances or textile fabrics

Procedures describe goal-oriented actions such as e.g.:

  • Manufacturing process (work or production steps to manufacture a product)
  • Control procedures (process steps when using a device or machine)
  • measurement method

The 3 requirements of patentability

Your invention can be protected by a patent if it meets the following requirements:

  1. The invention is new
    Your invention must not be part of the prior art. All knowledge that was publicly accessible anywhere in the world prior to the application is considered to be state of the art. These include e.g. B. written publications and Internet publications, but also public lectures or exhibitions. Even what you yourself make known about your invention is usually part of the state of the art - and your invention is no longer considered new. It is therefore essential that you keep the invention secret before registering it.
  2. The invention is inventive
    The invention must not be obvious to a person skilled in the art. In patent law, “the skilled person” is an imaginary person who knows the state of the art in the subject area but is unimaginative. If you ask a person skilled in the art your invention task and he immediately
